3. No engagement or client relationship

Browsing this site, downloading something from it, filling in a form on it, or sending us an email does not create a client relationship, a contract, an engagement or any obligation on either side. We take on work only under a written proposal and a signed statement of work. Until that is signed, nobody is committed to anything and no deadline, price or scope has been agreed.

Please do not send us confidential or sensitive information through an ordinary email or a website form before an engagement is in place. Truestep Solutions publishes free apps, including the Apex Health: Sleep & Recovery app for iPhone and Apple Watch. These apps are provided as is and as available, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non infringement. To the extent permitted by law, we accept no liability for any loss or damage arising from their use.

We publish no public source repositories at present. Support for our free apps is offered on a best effort basis and is not a service level commitment.

7. Apex Health is not a medical device

Apex Health: Sleep & Recovery provides general wellness and fitness information. It is not a medical device. It does not diagnose, treat, cure, mitigate or prevent any disease or condition, and it is not intended to replace advice from a doctor or any other qualified healthcare professional.

The Strain, Recovery, Sleep, Stress and Energy scores and the daily verdict are estimates calculated from data that Apple Health and Apple Watch provide, using published methods and reasonable assumptions. Sensor readings vary in accuracy, and no score should be read as a clinical measurement or a diagnosis. Never delay seeking medical advice, disregard advice you have been given, or change a treatment or a medication because of something the app showed you. If you feel unwell, or if a reading worries you, contact a healthcare professional. In an emergency, call your local emergency number.

8. Forward looking statements

This site sometimes describes plans, a roadmap, features under consideration, expected timings or directions we intend to take. Those statements describe our current thinking on the date they were published. They are not commitments, promises, guarantees or an offer, and they may change or be dropped entirely without notice as priorities, technology and circumstances change.

Do not make a purchasing decision, a build decision or an investment of your own time on the basis of a feature that has not shipped. If a specific capability matters to you, ask us, and if we agree to deliver it we will put it in a signed statement of work.

To the fullest extent permitted by applicable law, Truestep Solutions and the people who work with us are not liable for any indirect, incidental, special, consequential or exemplary loss, or for any loss of profit, revenue, data, goodwill or anticipated saving, arising out of your use of this site or of anything published on it. Nothing on this page excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence. Our contractual liability to clients is dealt with in the signed contract for that engagement, and that contract prevails over this page.
