Apex Health: Recovery Coach

Terms of Service

Effective date: July 26, 2026

These terms govern your use of the Apex Health: Recovery Coach app for iPhone and Apple Watch, including its widgets and Live Activities. By downloading or using the app you agree to them. If you obtained the app through the App Store, Apple's standard Licensed Application End User License Agreement also applies to the extent these terms do not cover a topic.

1. Who we are

The app is built and published by Truestep Solutions ("we", "us"), an independent software studio based in India. Contact: hello@truestepsolutions.in.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, for your own personal, non-commercial use, in accordance with these terms and Apple's App Store terms. We retain all rights not expressly granted.

3. Not medical advice

• Scores such as recovery, strain, stress, energy, and Apex Age are informational estimates built from your data using transparent heuristics. They are not medical measurements.
• Readings the app displays from Apple Health, including heart, glucose, cycle, and ECG related data, are shown for convenience and are not interpreted medically by the app.
• Nutrition estimates from meal scanning are approximations and may be inaccurate. Verify anything that matters, especially if you manage a medical condition.
• Training suggestions adapt to your data but cannot know your full circumstances. Stop exercising if you feel unwell and use your own judgment about what is safe for you.
• If you believe you are experiencing a medical emergency, contact emergency services immediately.

4. Your data and privacy

The app processes your health data on your device and we operate no servers that receive it. How data is handled is described in the Apex Health: Recovery Coach Privacy Policy, which forms part of these terms.

5. Price

The app is currently free, with no subscriptions and no in-app purchases. If paid features are ever introduced, they will be clearly presented in the app and covered by updated terms before you are charged anything.

6. Beta software

Builds distributed through TestFlight are pre-release software, may contain defects, and may change or stop working at any time. Apple's TestFlight terms also apply to beta builds. Feedback you send us about the app may be used to improve it without obligation to you.

7. Third party services and content

• Open Food Facts: product and nutrition information retrieved by barcode comes from the Open Food Facts community database, available under the Open Database License. The data is community contributed and we do not guarantee its accuracy or completeness.
• Open-Meteo: local weather used for hydration guidance comes from the Open-Meteo service. We do not guarantee its accuracy.
• Apple frameworks: the app relies on Apple Health, on-device Apple Intelligence models, iCloud key-value storage (used only to remember items you delete, as described in the Privacy Policy), and other Apple technologies, which are governed by Apple's own terms.

Apple, iPhone, Apple Watch, Apple Health, App Store, and TestFlight are trademarks of Apple Inc. Truestep Solutions, the Truestep mark, and Apex Health: Recovery Coach are our marks.

8. Acceptable use

You agree not to reverse engineer the app except where the law permits it despite this term, not to redistribute or resell it, not to use it to build a competing dataset, and not to use it in any unlawful way. You are responsible for keeping your device secure.

9. Disclaimers

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted or error free, or that estimates it produces will be accurate for you.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, health outcomes, or fitness results, arising from use of the app. Where liability cannot be excluded, our total liability is limited to the amount you paid us for the app in the twelve months before the claim arose, which for a free app is zero except where the law requires otherwise.

11. Termination

You may stop using the app and delete it at any time. We may end support for the app or these terms if you breach them. Sections that by their nature should survive termination, including sections 3, 9, 10, and 13, survive.

12. Apple specific terms

These terms are between you and Truestep Solutions, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claim relating to it, including product liability, regulatory compliance, or intellectual property claims. Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you. In case of the app's failure to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price paid, which for this free app is nothing; to the maximum extent permitted by law Apple has no other warranty obligation for the app.

13. Governing law

These terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts of India, without prejudice to any mandatory consumer protections that apply where you live.

14. Changes

We may update these terms as the app evolves. The effective date above reflects the latest revision, and material changes will be communicated inside the app. Continued use after a change means you accept the updated terms.
